SMI Part VII Transfer

This webpage provides information about the transfer of insurance business from Sunderland Marine Insurance Company Limited (SMI) to its parent company, The North of England Protecting and Indemnity Association Limited (NOE), under Part VII of the Financial Services and Markets Act 2000 (Transfer).


Business to be transferred

With effect from 00.00 BST on 30 June 2020, save for its insurance business in Argentina and Venezuela, all of SMI’s insurance business will be transferred to NOE in accordance with:

  1. an order of the High Court of England and Wales dated 16 June 2020 approving the Transfer; and
  2. an order of the Royal Court of Jersey dated 22 June 2020 approving the transfer of insurance business carried on by SMI within Jersey (Jersey Scheme).

Pursuant to the court orders the insurance business of SMI including its policies of insurance and reinsurance and related outwards reinsurance contracts will automatically transfer to NOE as from 00.00 BST on 30 June 2020.

Impact of the Transfer and Jersey Scheme

The Transfer and the Jersey Scheme will have no effect on:

  • the North Group’s obligations to you;
  • the terms and conditions of your cover;
  • the amount of your premium;
  • the duration of your policy or policies;
  • the way your policy is administered; or
  • any claim which you may have made or may make under your policy or policies, including the way any claims you have made or may make under your policy or policies are handled.

For transferring Clients, your relationship with the SMI personnel with whom you previously dealt will continue as before and “Sunderland Marine” will be a trading name of NOE.
