Payments Terms and Conditions
Sunderland Marine offers an online payment facility to pay the premium for your Policy.
Please read these terms carefully before making a payment using the online payment facility. Using the online payment facility indicates that you accept these Terms which form a legally binding contract between us. If you do not accept these Terms, then you should not use the online payment facility.
1. About these Terms
1.1 NorthStandard Limited, trading as Sunderland Marine, provides an online payment facility through which payments may be made in connection with an insurance policy.
1.2 These terms and conditions apply when you use the online payment facility. Please read them carefully before submitting a payment.
1.3 By selecting the relevant acceptance box and submitting a payment, you agree to these Terms. If you do not agree to these Terms, you should not use the online payment facility.
1.4 These Terms relate only to your use of the online payment facility. They do not replace or amend the terms and conditions of your Policy. If there is any inconsistency between these Terms and your Policy regarding the amount or due date of a premium, cancellation of the Policy or entitlement to a premium refund, the terms of your Policy will apply.
1.5 Nothing in these Terms affects any rights or remedies that you may have under applicable law.
2. Definitions
In these Terms:
Business Day means a day other than a Saturday, Sunday or public holiday in England on which banks in London are generally open for business.
Card Issuer means the bank or other organisation that issued the payment card used to make a payment.
Online Payment Facility means the online facility made available by us for the payment of premiums and other amounts due under or in connection with a Policy.
Payment Confirmation means the electronic confirmation issued following the successful authorisation and processing of a payment, as described in clause 4.
Policy means the insurance policy, or proposed insurance policy, to which a payment relates.
Policyholder means the person or organisation named as policyholder in the Policy.
Service Provider means Cardstream Limited, registered in England and Wales under company number 03864244, with its registered office at Birches Corner, Heron Gate, Taunton, Somerset, TA1 2LP, or any replacement payment service provider that we may appoint and identify through the Online Payment Facility.
Terms means these online payment terms and conditions.
we, us or our means NorthStandard Limited, trading as Sunderland Marine, registered in England and Wales under company number 0505456, with its registered office at 100 The Quayside, Newcastle upon Tyne, England, NE1 3DU.
you or your means the person using the Online Payment Facility, whether as the Policyholder or as a person authorised to make a payment on the Policyholder’s behalf.
3. Making a payment
3.1 The Online Payment Facility may be used only to pay premiums or other amounts that we have authorised to be paid through the facility.
3.2 Payments may be made using the card types shown as accepted on the payment entry screen. The card types available may change from time to time.
3.3 The payment entry screen will display the currency in which payment must be made. You are responsible for any currency conversion charges or other charges imposed by your Card Issuer.
3.4 Before submitting a payment, you must check that:
a. the Policy number and any other reference entered are accurate;
b. the payment amount is correct;
c. the email address entered is accurate and accessible by you; and
d. you are authorised to use the payment card.
3.5 By submitting a payment, you confirm that:
a. you are the cardholder or have the cardholder’s permission to use the card for that payment;
b. the information you have supplied is complete and accurate to the best of your knowledge; and
c. you are not using the Online Payment Facility fraudulently, unlawfully or in a manner that infringes another person’s rights.
3.6 You may be required to complete additional security or authentication checks requested by the Service Provider or Card Issuer. A payment may not be processed if those checks are not completed successfully.
3.7 You remain responsible for ensuring that the premium or other amount due under your Policy is paid by the applicable due date. Starting or attempting a payment does not by itself constitute payment.
4. Processing and confirmation
4.1 Payments submitted through the Online Payment Facility are processed by the Service Provider. We do not directly collect your payment card details through our systems.
4.2 Once a payment has been successfully authorised and processed, the Service Provider will:
a. send a Payment Confirmation to the email address entered on the payment entry screen; and
b. notify us of the payment.
4.3 After receiving notification from the Service Provider, we will update the relevant account as soon as reasonably practicable.
4.4 A Payment Confirmation indicates that the transaction has been successfully authorised and processed at that stage. It does not correct an inaccurate Policy number or other information entered by you, and does not prevent a payment from subsequently being reversed, cancelled or charged back.
4.5 If you do not receive a Payment Confirmation within two (2) Business Days after submitting a payment, we recommend that you contact us to check whether the payment has been received and allocated to the correct account. You should not submit a duplicate payment unless you have first checked whether the original payment was successful.
4.6 If the Online Payment Facility displays an error message or indicates that a payment has failed, you should check with your Card Issuer or contact us before attempting the payment again where there is a risk of duplicate payment.
4.7 The time at which a payment is credited to your Policy account may differ from the time at which the transaction is authorised. Any consequences of late or non-payment will be determined in accordance with your Policy and applicable law.
5. Declined, delayed and reversed payments
5.1 A payment may be declined, delayed or subject to additional checks by the Service Provider, Card Issuer or relevant payment network.
5.2 Where reasonably practicable, the Online Payment Facility or the Service Provider will indicate if a payment has not been successful. We cannot guarantee that we will separately notify you of every decline, delay or processing failure.
5.3 We are not responsible for a Card Issuer’s decision to decline or delay a payment. This does not exclude responsibility for anything that we or a person acting on our behalf has done or failed to do.
5.4 We may investigate a payment where we reasonably suspect fraud, unauthorised use, illegality, sanctions risk or a material error. We may delay allocating the payment while the investigation is conducted, provided that we act reasonably and do not restrict any rights that you have under applicable law.
5.5 If a payment is reversed, cancelled or charged back, we may adjust the relevant Policy account to reflect that reversal and seek payment of any amount that remains properly due.
5.6 Nothing in this clause limits any right you may have in relation to an unauthorised, incorrectly executed or disputed payment under applicable law or the applicable card scheme or Card Issuer procedures.
6. Security
6.1 Payment card details entered into the Online Payment Facility are handled by the Service Provider.
6.2 The Service Provider is responsible for applying appropriate technical and organisational measures to payment information processed through its payment environment.
6.3 We will apply appropriate technical and organisational measures to personal data processed within our own systems.
6.4 You are responsible for taking reasonable precautions when using the Online Payment Facility, including:
a. not making a payment on a device or network that you reasonably believe is insecure;
b. checking that you are using the genuine Sunderland Marine or NorthStandard payment page;
c. keeping card and security information confidential; and
d. closing the browser or payment session after completing the transaction, particularly when using a shared device.
6.5 Nothing in this clause makes you responsible for a security incident caused by us, the Service Provider or another person where responsibility properly rests with that person.
7. Personal data
7.1 We will process personal data relating to the Policyholder, the person making the payment and the payment transaction in accordance with applicable data protection law.
7.2 The personal data processed may include:
a. the payer’s name;
b. the Policy number or other payment reference;
c. contact information, including the email address entered on the payment screen;
d. the amount, currency, date and status of the payment;
e. limited payment card information made available to us by the Service Provider, such as the card type and masked card number; and
f. information used to prevent, detect or investigate fraud, security incidents or unlawful activity.
7.3 We may disclose relevant personal data to the Service Provider, Card Issuer, payment networks, professional advisers, insurers, regulators, law enforcement bodies and other recipients where disclosure is necessary to:
a. process, confirm, reconcile or refund a payment;
b. administer the Policy;
c. prevent or investigate fraud, security incidents or unlawful activity;
d. establish, exercise or defend legal rights; or
e. comply with legal or regulatory obligations.
7.4 We do not rely on your acceptance of these Terms as consent to processing that is necessary to process the payment, administer the Policy, pursue our legitimate interests or comply with legal or regulatory obligations. Where consent is required for a separate purpose, it will be requested separately.
7.5 Further information about how we process personal data, including applicable lawful bases, retention periods, international transfers, recipients and data protection rights, is available in the NorthStandard Privacy Policy.
7.6 The Service Provider may also provide its own privacy information where it processes personal data for purposes for which it determines the means and purposes of processing. Any such notice is separate from our Privacy Policy.
8. Errors, duplicate payments and refunds
8.1 If you believe that you have made a payment in error, paid an incorrect amount or submitted the same payment more than once, please contact us promptly.
8.2 We will investigate the request and, where a refund is due under the Policy, these Terms or applicable law, arrange the refund within a reasonable period.
8.3 For fraud prevention and payment security purposes, a refund will normally be made to the card originally used. If that is not possible, we may request additional information and use another reasonable and secure refund method.
8.4 We may request information reasonably required to identify and verify the payment, including:
a. the payer’s name;
b. the Policy number;
c. the payment amount;
d. the approximate date of payment;
e. the transaction reference, if available; and
f. limited card information, such as the final four digits of the card.
8.5 You should not send us the full card number, card security code, PIN, password or authentication credentials by email or through any other unsecured communication channel.
8.6 Any right to cancel the Policy or receive a return of premium will be governed by the Policy and applicable law. This clause does not limit any statutory or contractual right to a refund.
9. Availability of the Online Payment Facility
9.1 We aim to make the Online Payment Facility available when reasonably required, but cannot guarantee that it will always be uninterrupted, secure or free from errors.
9.2 We may suspend or restrict the Online Payment Facility where reasonably necessary for maintenance, security, fraud prevention, legal or regulatory compliance, or circumstances outside our reasonable control.
9.3 Where the Online Payment Facility is unavailable, you should contact us for information about any alternative payment method. Unavailability of the facility does not automatically extend a payment due date, but we will act reasonably when considering a delay caused by a failure of systems for which we or our Service Provider are responsible.
10. Responsibility and liability
10.1 Nothing in these Terms excludes or limits liability:
a. for death or personal injury caused by negligence;
b. for fraud or fraudulent misrepresentation;
c. for breach of any duty or liability that cannot lawfully be excluded or limited; or
d. in a manner that would restrict your statutory rights.
10.2 We are responsible for loss or damage that is a reasonably foreseeable result of our breach of these Terms or our failure to exercise reasonable care and skill.
10.3 Subject to clause 10.1, we will not be responsible for loss caused solely by:
a. materially inaccurate or incomplete information that you enter into the Online Payment Facility;
b. unauthorised card use by you;
c. a payment being declined or delayed by the Card Issuer for reasons outside our reasonable control;
d. a failure of your device, internet connection or other equipment outside our reasonable control; or
e. circumstances outside our reasonable control, except to the extent that we or a person for whom we are legally responsible caused or contributed to that loss.
10.4 If you use the Online Payment Facility wholly or mainly for purposes connected with your trade, business, craft or profession, we will not be responsible for loss of profit, revenue, business, contracts, anticipated savings or business opportunity arising from use of the facility, except where such liability cannot lawfully be excluded.
10.5 Nothing in these Terms excludes or limits any responsibility that we may have for the acts or omissions of the Service Provider where, under applicable law, the Service Provider is acting on our behalf or we are otherwise legally responsible for those acts or omissions.
11. Changes to these Terms or the Service Provider
11.1 We may change these Terms from time to time to reflect changes in law, regulation, technology, security requirements, payment processes or our business arrangements.
11.2 The Terms displayed when you submit a payment will apply to that transaction. A later change will not apply retrospectively to a completed payment.
11.3 We may replace the Service Provider. The identity of the payment service provider used for a transaction will be displayed or made available through the Online Payment Facility before the payment is submitted.
11.4 You may download or save a copy of the Terms applicable to your transaction.
12. Severability and waiver
12.1 If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.
12.2 If we do not immediately exercise a right under these Terms, that does not prevent us from exercising it later.
13. Governing law and jurisdiction
13.1 These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales.
13.2 If you are a consumer resident in another part of the United Kingdom, you may also be entitled to bring proceedings in the courts of the part of the United Kingdom in which you live.
13.3 If you are not a consumer, the courts of England and Wales will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
